These Terms of Service govern your use of the website located at https://www.littlebearkeepsakes.co.uk and any related services provided by Little Bear Clothing Keepsakes.
By accessing https://www.littlebearkeepsakes.co.uk, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by Little Bear Clothing Keepsakes.
We, Little Bear Clothing Keepsakes, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

By placing an order with Little Bear, you agree to the following terms:
Nature of Products
Each item is individually handmade from sentimental clothing or fabric provided by you. Due to the bespoke nature of the work, no two items are the same. Images on the website are for illustrative purposes only. Finished items may vary in appearance depending on the condition and characteristics of the fabrics supplied. Due to the nature of secondhand and worn fabrics, bears may be fragile and are not designed for frequent handling. Little Bear is not liable for any damage caused to the keepsake by improper handling. Keepsakes are not suitable for washing and only a gentle spot clean if necessary.
Fabric Requirements
Customers are responsible for providing clean, laundered (without fabric conditioner) garments in good condition. Items that are heavily worn, damaged, or unsuitable (including but not limited to leather, thick denim, loosely/hand-knitted items, sheer fabrics, underwear, or swimwear) may be rejected and returned. Additional washing will be carried out by Little Bear if necessary, and unusable items will be returned at the discretion of the maker. Please contact hello@littlebearkeepsakes.co.uk if you unsure of your fabrics’ suitability.
Garment Quantity
Specific garment requirements for each keepsake are outlined in the Information section. If insufficient or unsuitable garments are received, customers will be contacted to supply additional materials, with the cost of postage borne by the customer.
Handling and Alteration
By submitting clothing, you consent to those garments being cut, sewn, and permanently altered. Some fabrics will potentially be used or unused in part or in full. Any garments not used will be returned unless otherwise agreed. Off-cuts will be disposed of unless a written request for return is enclosed with the clothing. Once garments are cut, they cannot be reconstructed. If you have any specific design requests please include written notes when sending your garments and I will endeavour to meet them. Garments are lined with interfacing, cut and sewn together. Bears have plastic safety eyes inserted and a felt nose is hand stitched on. Bears and decorations are stuffed with polyester filling and cushions have a polyester insert.
Order Process and Delivery
Upon placing an order, you must include any personalisation details and send your garments with your order number to the address supplied. I recommend using strong, waterproof packaging and using a trackable service. Please ensure personalisation details are correct as I will use exactly what is supplied. Confirmation of receipt and an estimated turnaround time (typically up to 12 weeks) will be sent via email. Items are returned using tracked Royal Mail services. Little Bear is not liable for garments lost or damaged in transit. Items need to be sent to me within 14 days of the order date.
Product Safety
Memory Bears and keepsakes are strictly not toys and are sold as decorative items only. They come with the following safety warning: Memory Bears are not safety tested and are unsuitable for children under 14. Small parts and fragile fabrics pose a risk of injury and must be kept out of reach of children. Hanging decorations and cushions should also be kept out of the reach of children. Little Bear is not liable for any injury or damage caused by improper use.
Cancellations & Returns
Orders are non-refundable and cancellations cannot be accepted once clothing has been received. If you wish to cancel before sending your garments, please email hello@littlebearkeepsakes.co.uk. In the unlikely event of a fault, contact must be made within 14 days of receiving your order for resolution. Return shipping costs are the customer’s responsibility.
Intellectual Property & Use of Images
The design of all keepsakes remains the intellectual property of Little Bear. Bears are created using a licensed pattern from Funky Friends Factory and may not be reproduced commercially. Images of completed keepsakes may be used for promotional purposes unless you notify us not to in writing at the time of ordering. Any feedback received whether written or verbal, may be used for promotional purposes unless you request me not to. Customers are encouraged to credit Little Bear when sharing images and not share images of bears with children.
Gift Vouchers
Vouchers are valid for 12 months, are non-refundable, and cannot be exchanged for cash. The cost of sending clothing to Little Bear is the responsibility of the recipient. Any unused balance remains on the voucher. Lost, damaged or stolen vouchers cannot be refunded.
Payment
Payment is due in full at the time of ordering. Any additional delivery fees are clearly stated at checkout.
Limitations of Use
By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:
modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
remove any copyright or other proprietary notations from any materials and software on this website;
transfer the materials to another person or "mirror" the materials on any other server;
knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Little Bear Clothing Keepsakes provides;
use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
use this website or its associated services in violation of any applicable laws or regulations;
use this website in conjunction with sending unauthorised advertising or spam;
harvest, collect, or gather user data without the user's consent; or
use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.
Intellectual Property
The intellectual property in the materials contained in this website are owned by or licensed to Little Bear Clothing Keepsakes and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.
This constitutes the grant of a licence, not a transfer of title. This licence shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Little Bear Clothing Keepsakes at any time.
Liability
Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Little Bear Clothing Keepsakes makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.
In no event shall Little Bear Clothing Keepsakes or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Little Bear Clothing Keepsakes or an authorised representative has been notified, orally or in writing, of the possibility of such damage.
In the context of this agreement, "consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
